1. Purpose

This Withdrawal, Refund and License Renewal Policy sets out the rules governing the purchase, issuance, activation, refund handling, and renewal of MyOwnSMS licenses.

This policy must be read together with:

  • the WooCommerce checkout flow in effect at the time of purchase;
  • the MyOwnSMS Terms of Service;
  • the EULA, where separately provided;
  • the technical and operational documentation made available for the product.

2. Scope and Customer Type

MyOwnSMS is offered exclusively to business customers, professionals, and entities acting for purposes related to their trade, business, or professional activity.

MyOwnSMS is not intended for consumer purchases.

By purchasing a MyOwnSMS license, the customer represents and warrants that it is acting as a business customer or professional user and not as a consumer.

3. License Duration

Unless otherwise stated in the applicable commercial offer, each MyOwnSMS license is valid for twelve (12) months starting from the moment of purchase.

The relevant expiration date shall be traceable through the licensing flow, the order records, or the related administrative records.

Renewal is handled through a traceable and administrable process consistent with the technical licensing model in use at the relevant time.

4. License Issuance, Activation, and Renewal

A paid order results in the automatic creation of the related license key immediately after purchase, in accordance with the active commercial and technical flow.

For the purposes of this policy:

  • License issuance means the automatic generation of the license key following successful purchase.
  • License activation means the moment when the license key is inserted into the plugin.
  • License renewal means the purchase of a new annual license period, which generates a new license key.

The distinction between purchase, issuance, activation, and renewal is relevant for refund handling, technical dispute review, and license administration.

5. Withdrawal

Since MyOwnSMS is sold exclusively to business customers and professional users, the consumer right of withdrawal does not apply, except where mandatory law expressly provides otherwise in a specific case.

If an order is placed by a party that does not qualify as a business customer or professional user, MyOwnSMS reserves the right to review the order and adopt the appropriate operational or administrative measures based on the actual circumstances and applicable law.

Under EU and Italian consumer protection rules, the statutory right of withdrawal is a business-to-consumer protection framework, not a general B2B rule. (commission.europa.eu)

6. Refund Policy

Refund requests are assessed according to the actual status of the order, the related technical evidence, and the applicable contractual documentation.

6.1 Order Paid, License Not Yet Issued

If the order has been paid but the license has not yet been issued, the customer is generally eligible for a full refund, subject to payment verification, fraud controls, and administrative checks.

6.2 License Issued, Not Yet Activated

If the license has already been issued, even if it has not yet been activated, refunds are not granted.

6.3 License Already Activated

Once the license has been activated, refunds are not granted.

For the purposes of this policy, activation occurs when the license key is inserted into the plugin.

6.4 Confirmed Technical Malfunction Attributable to MyOwnSMS

If a material malfunction is confirmed and is attributable to MyOwnSMS, the case may be evaluated individually.

Depending on the verified circumstances, MyOwnSMS may decide, at its sole discretion or where required by law, to apply one of the following remedies:

  • technical remediation;
  • operational correction;
  • commercial credit;
  • partial refund;
  • full refund.

Any such decision shall be made on a case-by-case basis after review of the available technical and administrative evidence.

6.5 Customer Error, Incompatible Environment, or Non-Compliant Use

Refunds are not granted where the issue depends primarily on:

  • customer error;
  • unsupported or incompatible environment;
  • third-party conflicts outside the MyOwnSMS service perimeter;
  • misuse, abuse, or use not compliant with the applicable documentation or contractual terms.

7. General Operating Principle

MyOwnSMS does not apply a general automatic refund policy after license issuance or activation.

Refund and dispute handling may therefore be based on:

  • case-by-case review where expressly allowed under this policy;
  • technical records and timestamps;
  • support communications;
  • internal coordination between support, sales, and administration.

8. License Renewals

8.1 Renewal Process

Renewals are handled manually.

Renewal reminders may be sent starting thirty (30) days before the applicable expiration date.

8.2 Effect of Renewal

Upon renewal, the system generates a new license key.

8.3 Failure to Renew

If the license is not renewed by the applicable expiration date, the system will no longer function and the plugin may display a notice indicating that the license has expired.

8.4 Support After Expiration

No support is provided after license expiration.

9. Data and Evidence Retained

In order to manage disputes, refund requests, support matters, and renewal issues, MyOwnSMS may retain and use records such as:

  • order reference and payment status;
  • issued license reference;
  • activation status;
  • relevant domain or installation data;
  • device or pairing status, where applicable;
  • date and time of relevant technical steps;
  • support tickets and related communications.

Such records are processed in accordance with the applicable privacy documentation and internal retention practices.

10. Exceptional Requests

Requests falling outside the standard operating rules may be reviewed individually.

Any exceptional commercial remedy, goodwill credit, refund decision, or administrative adjustment remains subject to internal verification and final approval by Marco Franceschi.

11. Prevailing Rules

In the event of conflict between this policy and mandatory applicable law, mandatory law shall prevail.

In the event of conflict between this policy and the actual technical or contractual flow accepted at checkout, the binding contractual documentation and the verified transaction records shall be taken into account.
